1.0 Schedule 1 and 2 Development 1.1 Worcester City Council, in its role as the relevant Local Planning Authority, is satisfied that the proposed development would not fall within Schedule 1 of the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 (hereafter referred to as “the EIA Regulations”). 1.2 The development proposed would, however, fall within The proposed development is considered to be and is considered that the Proposed Development constitutes Schedule 2 of development under Section 10 (b) ‘Infrastructure Projects – Urban development’. The overall area of the development exceeds 5 ha. 1.3 It is first necessary to consider whether the development is located in a “sensitive area” as defined by the EIA Regulations and whether it is likely to have any significant effects on the environment. While the proposed development would change the appearance and nature of the site and the local landscape and will have other environmental effects, it is the case that the site the subject of this request for a Screening Opinion is not located within, or in close proximity to, one or more of the defined “sensitive areas” as set out in the regulations. 2.0 Schedule 3 2.0 Having given due consideration to advice with the PPG and the sections in Schedule 3, of the EIA Regulations it is considered that the environmental impact would only give rise to localised impacts that could be managed and mitigated through necessary planning conditions and possibly planning obligations that will be considered during any forthcoming planning applications. As such, I consider that the proposed development would not be so significant as to warrant an EIA. 3.0 Conclusion 3.1 There is no doubt that there are matters in relation to the potential development of the site for the intended purposes which may give rise to potential effects on the local environment, and these will require further detailed assessment which would be expected to accompany any subsequent planning application which may be forthcoming. Nevertheless, such matters taken individually and cumulatively are not considered to be so significant or beyond more than local in terms of potential impact. As such, and EIA would not be considered necessary.
