Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 21 of the South Worcestershire Development Plan (2016). |
| (A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. (B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 207, 210, 216 and 218 of the National Planning Policy Framework (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016. |
| Before the occupation of the development hereby permitted, details of a bat box to be installed shall be submitted to and approved in writing by the Local Planning Authority. The details to be submitted shall include an implementation timetable. The bat box shall be provided in accordance with the approved details and in accordance with the approved timetable and shall be retained for the lifetime of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
| The development hereby approved shall not be occupied until details of the design, implementation, maintenance and management of sustainable urban drainage/surface water drainage works have been submitted to and approved in writing by the Local Planning Authority. The submitted details shall: • provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; • include a timetable for its implementation; and • provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan (2016). |
| The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan. |
| The development hereby permitted shall not be occupied until sheltered, secure and accessible cycle parking has been provided in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Thereafter the provision shall be retained for the purposes of cycle parking only at all times. Reason: To comply with the Council’s parking standards. |
| The development hereby approved shall not commence until a Construction Environmental Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Duration of works; • Size, type and frequency of deliveries to include HGV routing; • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring; • Traffic management measures for construction vehicles on The Foregate to include temporary signage and the use of a banksman to oversee all vehicular manoeuvres; • Details of permitting for signage, skips and scaffolding, footway and road closures, road space booking as required; • Measures to ensure that mud or other detritus is not deposited on the public highway; • Details of site operative parking, material storage areas and the location of site operatives facilities as required; • Measures to demonstrate that those immediately affected by the construction works will be kept informed and due consideration and courtesy will be shown to the local community. • Contractors should be registered with the Considerate Constructors scheme and comply with the code of conduct in full. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety. |
| The development hereby approved shall not be occupied until a residential Travel Information Pack promoting sustainable forms of access to the development, has been submitted to and approved in writing by the Local Planning Authority. The pack shall be provided to each resident at the point of occupation. Reason: To reduce vehicle movements and promote sustainable access. |
| The development hereby approved shall not be occupied until details of the refuse and servicing strategy for the proposed dwellings, have been submitted to and approved in writing by the Local Planning Authority. The approved details shall be fully implemented prior to first occupation and shall be operational for the lifetime of the development. Reason: To ensure adequate on-site provision. |
| No demolition, construction or engineering works shall take place on any Sunday, Bank Holiday or Public Holiday, and such works shall only take place between the hours of 08.00 to 18.00 weekdays and 08.00 to 14.00 Saturdays. No plant, machinery or equipment associated with such works shall be started up or operational on the development site outside of these permitted hours. Reason: To mitigate the impact of construction to neighbouring residents in accordance with Policy SWDP 21 of the South Worcestershire Development Plan (2016) and the aims and objectives of the National Planning Policy Framework. |
| Prior to the commencement of the development, a Nuisance Management Plan detailing the proposed measures to monitor and mitigate emissions of noise, vibration (piling) and dust during the construction phase shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason: To safeguard neighbouring amenity during the construction phase. |
| Prior to occupation of the development hereby permitted, a satisfactory Secured by Design inspection must take place and the resulting Secured by Design certificate shall be submitted to and approved by the local planning authority in writing. Reason: To ensure that the development maintains and enhances community safety SWDP 21 of the South Worcestershire Development Plan (2016). |
| The apartments and co-living units hereby approved shall have an electronic door control system that meets the SBD specification. The delivery of mail should follow the guidelines outlined in the SBD guide. All residential doors should be dual certified for both security and fire, the doors should meet security standard PAS24:2022 or equivalent and have the appropriate fire and smoke rating. Reason: In the interests of security and safety. |
| No superstructure works shall commence until details to incorporate within the development hereby approved energy generation from renewable or low carbon sources equivalent to at least 10% of predicted energy requirements have been submitted to and agreed in writing by the Local Planning Authority. The approved details shall be implemented and operational prior to the first occupation of the development. Reason: To ensure the development meets the requirements of Policy SWDP 27 and associated guidance in the Renewable and Low Carbon Supplementary Planning Document and the aims and objectives of the National Planning Policy Framework to mitigate the impact of climate change. |
| The 8 co-living units and associated communal space hereby approved shall be occupied solely as a co-living accommodation and shall not be used for any other residential purpose, including as a House in Multiple Occupation (HMO) or self-contained flats, without planning permission first being obtained from the Local Planning Authority. Reason: To ensure the development is occupied in accordance with the approved use. |
| The development hereby approved shall be occupied in accordance with the following minimum tenancy periods: • Rooms 1 to 3 shall be occupied for short-term residential letting with a minimum tenancy length of no less than 3 consecutive days. • Rooms 4 to 8 shall be occupied for longer-term residential letting with a minimum tenancy length of no less than 6 consecutive months. No room shall be occupied outside of these specified tenancy terms unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development provides an appropriate mix of residential and visitor accommodation, protects residential amenity, and maintains a balanced and sustainable community, in accordance with SWDP 14 (Market Housing Mix) and SWDP 21 (Design) of the South Worcestershire Development Plan. |
| A register of all tenancies shall be maintained at the property and shall be made available to the Local Planning Authority within 7 days of a written request. The register shall include the following details for each tenancy: • The name of the tenant(s) • The room number occupied • The start and end dates of the tenancy • The duration of stay The register shall be kept up to date at all times and retained for a minimum period of 3 years from the date of each tenancy. Reason: To enable the Local Planning Authority to monitor and enforce compliance with the approved occupation arrangements, in the interests of residential amenity and in accordance with Policies SWDP 14 and SWDP 21 of the South Worcestershire Development Plan. |
| Prior to first occupation of the 8 co-living units hereby approved, a detailed Co-Living Management Plan shall be submitted to and approved in writing by the Local Planning Authority. This plan shall include: - Arrangements for on-site management and maintenance. - Measures to prevent and address anti-social behaviour. - Waste management and recycling strategy. - Fire safety and emergency procedures. - Access control and security measures. The Co-living Management Plan shall be subject to an annual review to ensure compliance with the approved Management Plan. Any revised Co-living Management Plan shall be provided to the Local Planning Authority. Reason: To ensure satisfactory site management and maintence, and appropriate safety and security measures. |
| The communal facilities, including but not limited to shared kitchen areas, co-working spaces, laundry rooms, and lounges, shall be maintained and remain accessible to all residents at all times. These facilities shall not be converted into additional residential accommodation. Reason: To ensure the occupation of the development is in accordance with the approved plans. |
| The co-living accommodation hereby approved shall remain under single ownership and shall not be subdivided or sold as individual units without prior written approval from the Local Planning Authority. Reason: To ensure compliance with the approved plans. |
