Condition Details / Information Notes
The proposed change of use, to a hot food takeaway (sui generis) from an existing retail use (Class E a) would result in a continuous frontage of three hot food takeaway units, and more that 30% in the secondary shopping frontage being in use for A3 (café), A4 (public house) or A5 (hot food takeaways) uses, contrary to the requirements of policy SWDP10 E i) and iii) of the South Worcestershire Development Plan.
The proposed change of use and associated operational development would result in harm to the character and appearance of the Lowesmoor Conservation Area, which is not outweighed by public benefits. The proposal is therefore contrary to policies SWDP6 and 24 of the South Worcestershire Development Plan and the requirements of the National Planning Policy Framework (2024).
On the basis of the submitted information it is considered that there is insufficient information to demonstrate that the proposal would not harm the living conditions of nearby residences, due to noise. The proposal therefore conflicts with Policy SWDP31 of the South Worcestershire Development Plan and the requirements of the National Planning Policy Framework (2024).
The proposed change of use to a hot food takeaway is in a location where there is evidence that the existing concentration of hot food takeaways is having an adverse impact on pollution and antisocial behaviour. The proposal for an additional hot food takeaway would result in an increase in the number of units and is therefore contrary to paragraph 97 of the National Planning Policy Framework (2024).
