Condition Details / Information Notes
The development hereby approved shall not be used for the sale of food (other than confectionary) and units shall only be used for the sale of carpets and floor coverings, furniture, furnishings, electrical goods, automotive products, DIY maintenance and improvements products for the home and garden (including the sale of kitchens and bathrooms), and for no other purposes without written agreement with the local planning authority. The sale of clothes, footwear and accessories shall be allowed in Unit E only and restricted to a maximum of 967 sq.m of net sales floorspace. An ancillary café and a concession of up to 100 sq.m of either stationery sales or a travel agent shall also be permitted in Unit E. Units will be used for no other purpose (including any other purpose in Class A of the schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that order with or without modification) without prior written agreement with the local planning authority. For the avoidance of doubt, the sale of confectionary shall be in a manner ancillary to the main business of any shop unit. Reason: To continue to ensure that the retail park does not have an adverse impact on the vitality and viability of the City Centre as the primary retail location for the city.
No goods, plant or machinery shall be stored or displayed for sale in the open without the consent of the Council. Reason: To maintain the visual and environmental quality of the site and surrounding area.
No operations shall be carried out on the site other than between the hours of 0830 to 2000. Reason: To maintain the residential amenity of the surrounding residential development.
If any tree shown to be retained is subsequently wilfully damaged or destroyed, uprooted, felled, lopped or topped or otherwise dies, it shall be replaced by two healthy trees of an appropriate size and species and in such locations as may be agreed in writing by the Local Planning Authority. Reason: To maintain the visual and environmental quality of the site and surrounding area.
Adequate car parking spaces shall be provided on the site for use by the disabled. Such spaces shall be satisfactorily identified and reserved solely for that purpose. Reason: To ensure the satisfactory provision of this necessary facility.
All the floorspace figures referred to in this consent, including the above conditions, relate to gross floorspace unless specified as sales area. Reason: To avoid ambiguity in the interpretation of this consent.
