Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out and completed in accordance with the following approved plans and associated documents and the specifications and recommendations contained therein, except where otherwise stipulated by conditions attached to this permission Location Plan Proposed Site Plan 25-246-4 Site/Parking Plan 25-246-5 Proposed Elevation and Floor Plan 25-246-2 Reason: To ensure compliance with the approved scheme and policy SWDP 21 of the South Worcestershire Development Plan.
Prior to occupation of the development hereby approved, a vehicular crossing (dropped Kerb) across the frontage of the site to correspond with the existing parking provision shall be properly constructed with details to be submitted in writing to and approved by the Local Planning Authority. REASON: In the interests of highway safety
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of highway safety
One native tree shall be planted within the application site prior to the first occupation of the development hereby approved. The tree shall be a native species appropriate to the local area and shall be planted in accordance with the principles and recommendations of BS 8545:2014 – Trees: from nursery to independence in the landscape – Recommendations. The tree shall be maintained for a minimum period of five years from the date of planting. Any tree that is removed, dies, or becomes seriously damaged or diseased within that period shall be replaced in the next available planting season with a tree of the same or similar native species and size, in accordance with the same British Standard. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service. Applications can be made online via the Worcestershire County Council website. The applicant is solely responsible for all costs associated with construction of the access.
The attention of the applicant is drawn to the need to keep the highway free from any mud or other material emanating from the application site during the construction phase of the development.
The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework.
