| The approved management and maintenance plan (25/00138/DOC, 2.5.2025) shall be implemented and the maintenance schedules adhered to as approved for the lifetime of the development. Reason: - To ensure that the development is properly drained, avoiding flood risk and pollution in accordance with Policies SWDP 28, 29 and 31 of the South Worcestershire Development Plan and in the interests of visual and residential amenity in accordance with Policies SWDP 5, 21, 22, 25 and 29 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seeks to protect and promote. |
| The approved (30.12.2022) Ecological Construction Method Statement shall be carried out fully in accordance with the approved details. Reason: - To ensure an appropriate method of construction and to provide a reliable process for after care and remedial measures to ensure the protection and survival of important protected and notable species and features of nature conservation importance in accordance with policy SWDP 22 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seeks to protect and promote with regard to the conservation and enhancement of the natural environment. |
| No building operations of any type shall be carried out unless protective fences (of at least 2 metres in height and in all other respects in accordance with BS 5837 (2012)), has been erected around the existing trees, shrubs and hedgerows to be retained within the site and around those trees outside the site whose Root Protection Areas (RPA) (as defined in BS 5837 (2012)) fall within the site, at the outer limit (or beyond) of the their RPA or in a position agreed in writing by the Local Planning Authority. Such fences shall be erected at a distance of not less than 2 metres beyond the canopy spread of the relevant trees, shrubs and hedgerows, and shall be erected before any materials are brought onto the site or development commences. Provision shall also be made for supervision of tree protection by a suitably qualified arboricultural consultant. Within the protected areas, land levels shall not be changed, no fires shall be lit, no equipment, machinery or vehicles shall be operated, parked or stored, , no rubbish shall be dumped, and no buildings erected inside the fence(s), no materials shall be stored or disposed of, and there shall be no mixing of cement or use of contaminating materials or substances. In the case of upright growing trees, the fences shall be located as required by the above specification or at a radius from the trunk of two thirds of the height of the tree, whichever is the greater. This tree protective fencing should remain in place until all construction and associated ground-works have been completed. Reason:- To ensure that those trees, shrubs and hedgerows to be retained are not subject to damage either as a result of works carried out on site or during the carrying out of such works in accordance with policies SWDP 22 and SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seeks to promote and protect with regard to the conservation and enhancement of the natural environment. |
| The development shall be carried out in accordance with the approved landscaping details (18.6.2024) Reason:- In the interests of the visual and environmental quality of the site and surrounding area and to ensure the satisfactory development of the site and to provide ecological mitigation and enhancement in accordance with policies SWDP 22 and SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seek to promote and protect with regard to the conservation and enhancement of the natural environment. |
| All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out by the developer in the first respective planting and seeding seasons following the completion of the development. Reason:- In the interests of the visual and environmental quality of the site and surrounding area and to ensure the satisfactory development of the site and to provide ecological mitigation and enhancement in accordance with policy SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seek to promote and protect with regard to the conservation and enhancement of the natural environment. |
| All planted and grassed areas and associated protective fencing will be maintained for a period of 5 years from the implementation of any specific area of landscaping. Within this period: - grassed areas will be maintained in a tidy condition by regular cutting and any areas that fail to establish will be reinstated; - planted areas will be maintained in a tidy condition by regular weeding; - any tree, shrub or plant which dies, becomes seriously diseased, damaged or is removed will be replaced with a tree, shrub or plant of the same or greater size and the same species as that originally required to be planted, unless the Local Planning Authority gives written consent to any variation, and such new planting shall be similarly maintained for a five year period from its planting; - any damage to protective and boundary fences will be made good. Reason:- In the interests of the visual and environmental quality of the site and surrounding area and to ensure the satisfactory development of the site and to provide ecological mitigation and enhancement in accordance with policy SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seek to promote and protect with regard to the conservation and enhancement of the natural environment. |
| The approved landscape management plan shall be carried out as approved. Reason:- In the interests of the visual and environmental quality of the site and surrounding area in and to ensure the satisfactory development of the site and to provide ecological mitigation and enhancement in accordance with policies SWDP 22 and SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seek to promote and protect with regard to the conservation and enhancement of the natural environment. |
| Works to hedgerows and trees shall only take place outside of the bird nesting season (1st March to 31st August inclusive) unless a qualified ecologist has first confirmed that no nesting birds are present. If nesting birds are found, works shall not commence to those hedgerows or trees until birds have fledged (as confirmed in writing to the local planning authority by the ecologist). Reason:- To ensure the preservation and protection of nesting birds in accordance with policies SWDP 22 and SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seeks to protect and promote with regard to the conservation and enhancement of the natural environment. |
| The development shall be carried out in accordance with the approved (18.6.2024 ) Drainage Strategy. Reason: To ensure that the site can be adequately drained in accordance with policy SWDP 29 of the South Worcestershire Development Plan and paragraph 165 of the NPPF 2018 and to ensure that the development is provided with a satisfactory means of drainage as well as to reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution. |
| Construction shall be carried out in accordance with the approved Construction Environmental Management Plan (30.11.2022 ). Reason:- In order to ensure that the development of the site is undertaken following best practice and to ensure the protection of the amenities of nearby land users and activities and in accordance with policy SWDP 21 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy seeks to protect and promote with regard to amenity. |
| The development shall be carried out and completed in accordance with the approved earthworks/slab level details (18.6.2024), prior to the occupation of the first dwelling, unless an alternative timescale is agreed in writing by the local planning authority. Reason:- In order to ensure the development is assimilated with existing site contours and wider landscape, to ensure a satisfactory standard of design and appearance for the development, in accordance with policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy seeks to protect and promote. |
| The pre-commencement visibility splays required by condition 20 of 20/00775/FUL (measured from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4m back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 59m to the east and 74m to the west, measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway) shall be maintained, such that the visability splay described, in the triangular area of land so formed, is not obstructed. Reason: In the interests of highway safety. |
| The development hereby approved shall be carried out in accordance with the approved off site highway works (12.2.2025), and the S38/278 WORKS PLAN (Revised 13/06/25). Reason: To ensure the safe and free flow of traffic onto the highway and faciliate pedestrian connectivity, in accordance with policy SWDP21 of the South Worcestershire Development Plan and the requirements of the National Planning Policy Framework 2024. |
| The development hereby permitted shall not be first occupied until the approved sheltered, secure and accessible cycle parking (11/2/2025) has been provided. Thereafter, it shall be retained and made available for such use, for the lifetime of the approved use. Reason: To comply with the requirements of the Worcestershire County Council Streetscape Design Guide Supplementary Planning Document. |
| The approved Travel Plan (11/2/2025) shall be implemented prior to the first occupation of any of the dwellings, monitored for a minimum of 5 years from that date and shall be updated in agreement with Worcestershire County Council’s Travel Plan Officer and thereafter implemented as updated. Reason: To reduce vehicle movements and promote sustainable access. |
| No construction site machinery or plant shall be operated, no process shall be carried out and no construction-related activities taken or dispatched from the site except between the hours 07:30 and 18:00 on Mondays to Fridays, between 08:00 and 13:00 hours on Saturdays, and not at any time on Sundays, Bank Holidays or other public holidays. Reason:- To safeguard the amenities of neighbouring residents in accordance with policy SWDP 21 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy seeks to protect and promote with regard to amenity. |
| The approved renewable energy measures (1.12.2022) shall be implemented and completed prior to the occupation of the dwelling/building to which it relates. Reason: - In the interests of achieving an energy and resource efficient development in accordance with policy SWDP 27 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote. |
| The development shall be carried out only in accordance with the approved external lighting details (25/00138/DOC 2/5/2025) and thereafter maintained as such, unless amended details are first submitted to and approved in writing by the local planning authority. Reason:- To protect the potential habitat and foraging routes of bats which are protected under the Natural Environment and Rural Communities (NERC) Act, 2006, The Conservation of Habitats and Species Regulations, 2010, The Wildlife and Countryside Act, 1981(as amended), The Countryside and Rights of Way (CRoW) Act, 2000, Habitats Directive and in accordance with policies SWDP 21, 22 and 31 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote. |
| Prior to the first occupation of the dwelling to which it relates, the approved super-fast broadband connection (17.10.2022) shall be provided. | Prior to first occupation of the dwelling to which it relates, an Ultralow NOx boiler in accordance with the approved details (11.2.2025) shall be provided, and retained thereafter unless they need to be replaced in which case the replacement boiler shall be of the same specification or have a lower NOx emission output. Reason:- To reduce pollution in accordance with policy SWDP 31 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote. |
| No dwelling shall be occupied until the approved hydrant(s) (11/2/2025) have been provided in accordance with the approved details. Reason:- In the interests of fire safety in accordance with policy SWDP 21 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote.. |
| The approved means of enclosure (1.12.2022) shall be erected, in accordance with the approved details, prior to the first occupation of the dwelling to which it relates and shall be retained as such thereafter. Reason: To ensure the satisfactory appearance of the completed development, to safeguard the privacy of the occupants of the existing and proposed dwellings and to comply with policy SWDP 21 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote. |
| Notwithstanding the provisions of Classes A to E (inc.) of Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 and its subsequent amendments, the approved dwellings on plots shall not be extended, nor shall any structures be erected within the curtilage of the said dwellings, without the grant of further specific planning permission from the Local Planning Authority. Reason: To enable the Local Planning Authority to retain planning control over the development of this site in order to safeguard the amenities of the future occupants of the adjoining dwellings in accordance with policy SWDP 21 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote.. |
| Notwithstanding the provisions of Classes A, B and C of Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 and its subsequent amendments, no new windows, rooflights or other openings, other than those shown on the approved plans, shall be inserted in the walls or roof of the dwelling without the grant of further specific planning permission from the Local Planning Authority. Reason: To enable the Local Planning Authority to retain planning control over the development of this site in order to safeguard the amenities of future occupants of the adjoining dwellings in accordance with policy SWDP 21 of the South Worcestershire Development Plan and the aims and objectives that the National Planning Policy Framework seeks to protect and promote. |
| The approved works (1.12.2022) to the existing hedge adjacent to Taylor’s Lane to accommodate the route of footpath shall be completed prior to the first occupation of the development and shall be maintained at all times thereafter. Reason: To ensure that satisfactory pedestrian connectivity is achieved, in the interests of providing sustainable travel options for occupiers, so as to accord with policy SWDP21 of the South Worcestershire Development Plan and the principles of the National Planning Policy Framework 2024. |
| The mitigation measures set out in the approved Noise Impact Assessment (17.10.2022 & 8.9.2025 (25/00760/DOC) shall be implemented before the first occupation of the development to which it relates and shall be retained thereafter. Reason: In the interests of the amenities of future residents in accordance with policies SWDP 21 and SWDP 31 of the South Worcestershire Development Plan and the aims and interests that the National Planning Policy Framework seeks to protect and promote with regard to amenity. |
| The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework. |
| Pre-Maintenance Checks and Inspections Upon practical completion of construction, the Applicant shall submit the following to the Highway Authority for review: • As-built and record drawings for all highway elements. • Commissioning certificates for street lighting, traffic signals and any new structures. • CCTV drainage surveys, together with pressure and deflection test results for pipes and ducts. • Surface friction test certificates and carriageway surface tolerance surveys. • Operation and maintenance manuals, materials certificates and permit/licence sign-off (e.g., S171, S50). Stage 3 Road Safety Audit and Defect Resolution A Stage 3 Road Safety Audit (Post-Construction Pre-Opening Audit) must be carried out in accordance with DMRB GG 119 and submitted to the Highway Authority for approval. The Applicant is responsible for rectifying all safety issues identified in the RSA 3 report. No audit shall be deemed complete until the Highway Authority confirms that all recommendations have been implemented to its satisfaction. Substantial Completion Certificate No Substantial Completion Certificate will be issued by the Highway Authority under the Section 278 Agreement until all of the following have been satisfied: 1. All technical approval conditions have been discharged. 2. All Road Safety Audit stages (1, 2 and 3) have been completed and signed off. 3. All pre-maintenance checks, inspections and tests have passed and accompanying documentation approved. 4. All defects identified during audits and inspections have been rectified and verified by the Highway Authority. Failure to comply with any of the above requirements will delay the issue of the Substantial Completion Certificate. |
| The applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this permission is safeguarded in any sale of the application site or part(s) thereof. |
| This consent does not authorise the erection of temporary direction signs on the public highway. Should the applicant wish to direct traffic to the development site they should seek the consent of the Highway Authority. All temporary directional sign proposals should be submitted to the Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No signs should be erected without the consent of the Highway Authority. |
| The attention of the applicant is drawn to Section 59 of the Highways Act 1980 which allows the Highway Authority to recover additional costs of road maintenance due to damage by extraordinary traffic. Before any work is commenced upon the development hereby approved representatives of Worcestershire County Council, as the Highway Authority and the applicant, shall carry out a joint road survey/inspection on the roads leading to this site. Any highlighted defects shall be rectified to the specification and satisfaction of the Highway Authority before work is commenced on the development hereby approved. A further joint survey/inspection shall be undertaken following completion of development hereby approved and any necessary remedial works shall be completed to the specification and satisfaction of the Highway Authority within 1 month or other agreed timescale. |
