| Worcester City Council of The Guildhall, High Street, Worcester WR1 2EY HEREBY CERTIFY that application reference 25/00382/CLPU registered on 23 April 2025 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and on the plan attached to this Notice, as the matter described in the First Schedule to this Notice would not be lawful as at the 21 June 2025 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- The proposed change of use from Use Class C4 (House in Multiple Occupation) to Use Class C2 (Residential Institution – Children’s Home) would result in a material change of use. This is due to the introduction of a regulated care environment involving shift-working carers, management oversight, and increased levels of comings and goings from staff, professional visitors, and family members. These factors fundamentally alter the character and intensity of the use compared with the existing HMO use, thereby constituting development requiring express planning permission. That the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) thus requiring planning permission. |
