Condition Details / Information Notes
This 'Notice of Consent' shall be extant for a period of 2 years from the date of this Notice. Should the works approved under this consent not be undertaken within this period, then a further Tree Preservation Order application would be required. Reason: To conform with the requirements of The Town and Country Planning (Tree Preservation) (England) Regulations 2012.
No later than 7 days before works are to be carried out on the tree, written notice shall be given to the Local Planning Authority of the date when works shall commence. No works shall commence until the applicant's nominated contractor has discussed the works on site with a representative of the Local Planning Authority. Reason: To ensure the work is carried out in such a manner as to maintain the quality of the environment in accordance with policy SWDP25 of the South Worcestershire Development Plan and aims and objectives of the National Planning Policy Framework.
Consent is hereby granted for the works to the tree(s) subject to the limitations specified in the schedule attached hereto. All works shall be carried out in accordance with the schedule and in compliance with British Standard BS 3998:2010 "Recommendations for Tree Work". Reason:- To maintain the visual and environmental quality of the site and surrounding area in accordance with policy SWDP25 of the South Worcestershire Development Plan and aims and objectives of the National Planning Policy Framework.
Notwithstanding any details on the submitted application forms, plans , and photographs the consent hereby granted is for the following works:- Schedule:- T1 Common Oak - I. Reduce height by up to 2 metres and lateral spread by up to 1.5 metres per side (maximum 3 metres total), pruning to suitable growth points to maintain natural form. II. Raise the crown to provide 4 metres clearance above ground level, removing secondary and tertiary branches less than 10cm in diameter only. III. Selectively prune to achieve up to 2 metres clearance from adjacent dwellings, ensuring all pruning cuts are to growth points and there are no head cuts. IV. Remove deadwood throughout the crown in the interests of safety and tree health. Reason:- To ensure the work is carried out in such a manner as to maintain the quality of the environment in accordance with policy SWDP25 of the South Worcestershire Development Plan and aims and objectives of the National Planning Policy Framework.
The proposed 30% crown reduction is refused as it would result in excessive removal of live growth, adversely affecting the tree’s health, structure, and amenity value. The extent of reduction exceeds best practice guidance and is not justified by the tree’s condition or setting.
