| The proposed dwelling, by virtue of its scale, massing, footprint, and design features, would appear out of keeping with the established character and appearance of the surrounding residential area. The proposal fails to respect the prevailing pattern of development and would result in an incongruous and visually intrusive form of development, contrary to Policy SWDP 21 of the South Worcestershire Development Plan and the design objectives of the National Planning Policy Framework. |
| The proposed development fails to demonstrate how it would deliver a measurable net gain in biodiversity in accordance with the requirements of Section 40 of the Natural Environment and Rural Communities Act 2006 (as amended), Section 90A of the Town and Country Planning Act 1990 (as inserted by the Environment Act 2021) or that any relevant exemption applies. The Local Planning Authority is unable to conclude that the development would achieve at least a 10% net gain in biodiversity. The proposal would therefore result in harm to biodiversity interests and is contrary to the objectives of the National Planning Policy Framework which seek to conserve and enhance the natural environment and fails to comply with Policy SWDP 22 of the South Worcestershire Development Plan and the provisions of the Environment Act 2021. |
| The Local Planning Authority has acted positively and proactively in determining this application by identifying matters of concern with the proposal and determining the application within a timely manner, clearly setting out the reason for refusal, allowing the Applicant the opportunity to consider the harm caused and whether or not it can be remedied by a revision to the proposal. |
