Condition Details / Information Notes
The extension as proposed would breach the 45 degree code as set out within the adopted South Worcestershire Design Guide SPD and would result in an unacceptable impact to the neighbouring amenity of the adjoining terraced house, Number 172 Bath Road, in terms of over-shadowing, loss of daylight and sunlight, obstruction of outlook and overbearing. As such the development is contrary to Policy SWDP21 of the South Worcestershire Development Plan and the South Worcestershire Design Guide SPD as well as the wider objectives of the National Planning Policy Framework.
The Local Planning Authority has acted positively and proactively in determining this application by identifying matters of concern with the proposal and determining the application within a timely manner, clearly setting out the reason for refusal, allowing the Applicant the opportunity to consider the harm caused and whether or not it can be remedied by a revision to the proposal.
