Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out and completed in accordance with the following approved plans and associated documents and the specifications and recommendations contained therein, except where otherwise stipulated by conditions attached to this permission Location Plan Location/Block Plan Proposed Floor Plan Proposed Floor and Elevations NC 02 Reason: To ensure compliance with the approved scheme and policies SWDP 6,21 and 24 of the South Worcestershire Development Plan.
The premises shall only be open to customers between the hours of: 11:00 to 23:00 Sunday to Thursday 11:00 to 00:30 on Friday and Saturday The premises shall not be open to customers outside of these hours. Reason: To protect the amenities of neighbouring residents in accordance with Policy SWDP 21 of the South Worcestershire Development Plan and the National Planning Policy Framework.
No outdoor seating area, drinking area, or external customer area shall be provided or operated at the premises at any time unless otherwise agreed in writing by the Local Planning Authority. Reason: To safeguard the amenities of nearby residential properties in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
All entertainment activities shall take place within the enclosed building only. No amplified music or sound shall be played outside the building at any time. Reason: To protect the amenities of neighbouring residents in accordance with Policy SWDP 21 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework.
