Condition Details / Information Notes
Having considered all relevant matters, including the requirements of legislation in s96A and previous non-material amendments (P17D0300), the proposed changes are considered to be non-material to the planning permission when considered individually and cumulatively and would not affect the scope of the planning permission, the associated conditions. For the avoidance of doubt and having regard to previous approved non-material minor amendments ref: P17D0300, the approved plans condition condition 2 of planning permission P15D0225 is updated. For the avoidance of doubt Condition 2 now reads: The development hereby permitted shall be carried out and completed in accordance with the following approved plans and the associated submitted documents and thereafter shall operate in accordance with the specifications and recommendations contained therein, including the recommendations set out in sections 7 and 8 of the Aspect Ecology Ecological Appraisal, except where otherwise stipulated by conditions attached to this permission: Location Plan NMA1 Landscape Plan NMA2 Floor Plan Plot 1 - Drawing 01A Floor Plans Plots 2-4 - Drawing 02A Floor Plan Plot - 5 - Drawing 03A Elevations Plot 1 - Drawing 04A Elevations Plots 2-4 - Drawing 05A Elevations Plot 5 - Drawing 06A Parking Layout - Drawing 13 Ecological Mitigation and Enhancements - Drawing 1813/EC06 Rev A Lark Hill Road Management Plan 2025 Fence Detail Document Reason: To define the permission.
Before the end of the next planting season (the end of 30th April 2026); a) any hedgerow plants, along the western site boundary between the swale and the railway embankment, that have died by the date of this decision shall be replaced with plants of the same species, size and means of cultivation.; and b) two fruit trees shall be planted, in accordance with drawing NMA 2 – Landscaping Plan. Thereafter, the hedgerow and trees shall be maintained in accordance with approved Ecological Restoration and Management Plan (Aspect Ecology, dated August 2017). Reason: To ensure that the development contributes to the conservation and enhancement of biodiversity within the site and to accord with the requirements of policies SWDP22, 25 and 38 of the South Worcestershire Development Plan and the National Planning Policy Framework.
This is a non-material amendment to planning permission P15D0225, dated 22 July 2016 and, otherwise than is altered by this approval, the development shall be carried out in accordance with that planning permission and the conditions attached thereto. Reason: For the avoidance of doubt and to comply with the requirements of the South Worcestershire Development Plan and the National Planning Policy Framework.
