Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out and completed in accordance with the following approved plans and associated documents and the specifications and recommendations contained therein, except where otherwise stipulated by conditions attached to this permission Location and Block Plan Proposed Floor Plan Proposed Location and Block Plan Site Management Plan dated 6 March 2026 Reason: To ensure compliance with the approved scheme and policy SWDP 21 of the South Worcestershire Development Plan. and polices SWDPR 28 & 35 of the emerging South Worcestershire Development Plan Review.
The premises shall be used solely as a residential care home for a maximum of three children aged between 6 and 18 years, with care provided on a 24-hour basis by staff working on a shift pattern, and for no other purpose within Use Class C2 of the Town and Country Planning (Use Classes) Order 1987 (as amended), or any statutory instrument revoking and re-enacting that Order with or without modification. Reason: In the interests of residential amenity and to ensure that any intensification of use is subject to further consideration by the Local Planning Authority.
At least one member of care staff shall be present on the premises at all times when children are in residence. Reason: To ensure the safe management of the home in the interests of the children, neighbouring amenity, and community safety.
The use hereby permitted shall be carried out in accordance with the approved Site Management Plan dated 6th March 2026. The Site Management Plan shall be implemented in full upon first occupation of the development and shall thereafter be adhered to for the lifetime of the use. The Plan shall include details of staffing arrangements, shift patterns and handovers, parking management, property maintenance, and safeguarding measures. No changes to the approved Site Management Plan shall take place unless otherwise first agreed in writing by the Local Planning Authority. Reason: To ensure that the development is operated in a manner consistent with that assessed, in the interests of residential amenity, highway safety, and the character of the area, in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan, polices SWDPR 6, SWDPR 28 and SWDPR 35 of the emerging South Worcestershire Development Plan Review and the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the access including dropped kerb works and parking for 3 vehicles, have been provided, as generally shown on the Block Plan, drawing no. NFC/03/2026 A. Thereafter the provision shall be retained for the specified purposes only at all times. REASON: In the interests of highway safety
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of highway safety
The Development hereby approved shall not be occupied until the cycle parking shown on the Block Plan, drawing no. NFC/03/2026 A has been provided, with details to be submitted to and approved in writing by the Local Planning Authority. Thereafter the provision shall be retained for the purposes of cycle parking only, at all times. REASON: To promote active travel and to comply with County standards
This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service. The attention of the Applicant is drawn to the need to keep the highway free from any mud or other material emanating from the application site during the construction phase of the development.
The applicant is reminded that this planning permission does not override the requirement to obtain and maintain appropriate registration and compliance with Ofsted and any other relevant regulatory bodies in respect of the operation of the premises as a children’s home.
The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework.
