The Applicant is advised that Exolum Pipeline System Ltd has confirmed that its apparatus is affected by the development. The pipeline and associated infrastructure are protected under the Energy Act 2013 and the Pipeline Safety Regulations 1996, and an easement strip of 6 metres applies. No works or intrusive activities should be undertaken within the vicinity of the pipeline without first contacting Exolum to obtain appropriate guidance and, where necessary, a formal Works Consent. Exolum should be contacted within 28 days of the date of their correspondence, quoting reference 261602, to validate the enquiry. Failure to do so may result in the enquiry becoming void. Applicants and contractors are reminded of their duty of care to avoid damage to pipeline apparatus, including during works carried out outside the easement strip, and should ensure that all necessary precautions are taken prior to commencement of development.
The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework.
