| Worcester City Council of The Guildhall, High Street, Worcester WR1 2EY HEREBY CERTIFY that application reference 26/00385/CLPU registered on 5 May 2026 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and shown on the plan submitted with the application, for the following reason:- The Local Planning Authority is not satisfied, on the balance of probability, that the matter described in the First Schedule would be lawful. The proposed formation of a vehicular access and associated hardstanding would involve excavation, regrading of land levels and associated engineering operations and therefore constitutes operational development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended), requiring planning permission. The works would extend beyond the scope of permitted development rights under Schedule 2, Part 1, Class F of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), which are limited to the provision or replacement of hard surfaces. Furthermore, the proposed vehicular access would not benefit from permitted development rights under Schedule 2, Part 2, Class B of the GPDO, as it has not been demonstrated that the access is required in connection with any other form of permitted development. In addition, the proposed access is dependent upon alterations to the existing front boundary wall and gate piers, which the Local Planning Authority considers to be curtilage-listed structures associated with the Grade II listed buildings at Nos. 4 and 6 The Moors. The proposed works would therefore also require Listed Building Consent under the Planning (Listed Buildings and Conservation Areas) Act 1990. Accordingly, the matter described in the First Schedule would not be lawful within the meaning of Section 192 of the Town and Country Planning Act 1990 (as amended). |
