The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
The development hereby permitted shall be carried out and completed in accordance with the following approved plans and associated documents and the specifications and recommendations contained therein, except where otherwise stipulated by conditions attached to this permission:

Reason: For the avoidance of doubt and to secure a satisfactory form of development in accordance with policy SWDP 21 of the South Worcestershire Development Plan and aims and objectives of the National Planning Policy Framework.

No superstructure works shall take place until samples and full particulars of all external facing materials to be used in the construction of the development have been submitted to and approved in writing by the Local Planning Authority. The development shall not be carried out other than in accordance with the approved details.
Reason: To ensure a satisfactory external appearance of the development and that high quality materials and finishes are used, in accordance with Policy SWDP 21 of the South Worcestershire Development Plan (2016). |
The demolition and development hereby approved shall not commence until a Construction Environmental Management Plan (CEMP) has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following: -
a) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
b) Details of site operative parking areas, demolition and development material storage areas and the location of site operatives’ facilities (offices, toilets etc);
c) Working hours for demolition and construction
d) Arrangements and hours for deliveries
The measures set out in the approved Plan shall be carried out and complied with in full during the demolition and construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority.
Reason: To ensure the provision of adequate facilities and in the interests of highway safety and residential amenity, to comply with policies SWDP 4 and 21 of the South Worcestershire Development Plan, the Worcestershire County Council Streetscape Design Guide (July 2022) and the requirements of the National Planning Policy Framework. |
Prior to the site being open for public use the following details shall be submitted to and approved in writing by the local planning authority:
a) The inclusion of a public information board regarding the history of the site and its immediate surroundings, a timetable for its installation and maintenance. The development shall be carried out in accordance with the approved details and the notice board retained thereafter.
Reason: To allow the historical and archaeological potential of the site and buildings to be managed and recorded in accordance with policies SWDP 6 and SWDP 24 of the South Worcestershire Development Plan and aims and objectives of the National Planning Policy Framework.

Within three months of the date of this permission hereby approved, full details of the fencing and palisade fencing (including height, position, materials and treatments) to the northern boundary with the neighbouring bus depot, to protect pedestrians and cyclists from spray/wash, should be submitted for approval.
Reason: To provide an appropriate level of amenity to future residents in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.

The development hereby approved shall not commence unless and until a detailed scheme of works (including a Construction Method Statement which ensures highway safety is maintained at all times) for the Shared Use Link and its connections to Pheasant Street, which are broadly in accordance with General Arrangement drawings SHQ-501A and SHQ-502A, is submitted to and agreed in writing by the Local Planning Authority (in consultation with Worcestershire County Council Highways as Technical Approval Authority). The development scheme shall be constructed and implemented in full accordance with the approved details.
Reason: In the interests of providing safe and suitable access for all users. |
The development hereby approved shall not commence unless and until a detailed lighting scheme for the Shared Use Link and its connections to Pheasant Street is submitted to and agreed in writing by the Local Planning Authority (in consultation with Worcestershire County Council as Highway Authority). The development scheme shall be constructed and implemented in full accordance with the approved details.
Reason: In the interests of providing safe and suitable access for all users. |
The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:
• Quantification of construction traffic two-way movements, by vehicle type (including special or abnormal loads) and time of day throughout the construction phase of the development to the compound;
• Confirmation of construction traffic access routes;
• Identification of any temporary works or traffic management measures required to safely accommodate construction traffic movements, including the removal and/or relocation of any street furniture and/or highway assets;
• Measures to ensure that vehicles leaving the site/site compounds do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc).
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring;
• Details of any temporary construction accesses and their reinstatement; and
• A highway condition survey, timescale for re-inspections, and details of any reinstatement; and
• Details of any pedestrian and/or cycle route diversions.
The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations
approved, in writing, by the Local Planning Authority.
Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety. |
Full details of any soil or soil forming materials brought on to the site for use in garden areas, soft landscaping, filling and level raising must be provided. Where the donor site is unknown or is brownfield the material must be tested for contamination and suitability for use on site. Full donor site details, proposals for contamination testing including testing schedules, sampling frequencies and allowable contaminant
concentrations (as determined by appropriate risk assessment) must be submitted to and approved in writing by the Local Planning Authority prior to import on to the site.
The approved testing must then be carried out and validatory evidence (such as laboratory certificates) submitted to and approved in writing by the Local Planning Authority prior to any soil or soil forming materials being brought on to site.
Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.

In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with:
1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place.
2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site.
Reason To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors. |
No development shall commence until detailed design drawings for surface water drainage have been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details.
Reason To ensure that the site can be adequately drained in accordance with paragraph 165 of the NPPF 2018 and policy SWDP29 of the South Worcestershire Development Plan. |
Prior to the commencement of any external construction works in respect of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include: - a) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. b) a written specification outlining cultivation
and other operations associated with plant and grass establishment. c) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner, and thereafter retained and /or replaced.
Reason: To ensure the proposed development would provide high quality landscaping,integrate into its surroundings and provide an appropriate external amenity area for future occupants of the approved development, in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the requirements of the of National Planning Policy Framework 2021. |
The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including planning policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out within the National Planning Policy Framework.
